According to common-sense morality, agents can become morally connected to the wrongdoing of others, such that they incur special obligations to prevent or rectify the wrongs committed by the primary wrongdoer. We argue that, under certain conditions, voluntary and unjustified observation of another agent’s degrading wrongdoing, or of the ‘product’ of their wrongdoing, can render an agent morally liable to bear costs for the sake of the victim of the primary wrong. We develop our account with particular reference to widespread (...) modern phenomena such as so-called ‘revenge porn’, ‘up-skirting’, and the online observation of sexual assault and murder. On our account, observation is not a sui generis basis of liability. Instead, observation grounds liability in virtue of manifesting three, more general, grounds of liability. First, observation can compound a primary wrong, making that wrong more harmful for the victim. Second, observation can constitute degrading treatment of the victim. Third, in certain cases observation can enable primary wrongdoing. We conclude by discussing the conditions under which observing degrading wrongs might be morally justified. (shrink)

The space of possible worlds is vast. Some of these possible worlds are materialist worlds, some may be worlds bottoming out in 0s and 1s, or other strange things we cannot even dream of… and some are idealist worlds. From among all of the worlds subjectively indistinguishable from our own, the idealist ones have uniquely compelling virtues. Idealism gives us a world that is just as it appears; a world that’s fit to literally enter our minds when we perceive it. (...) If the world is an idealist world, we live in a perceptual Eden. We did not fall from Eden. Rather, we deluded ourselves into believing that we couldn’t possibly live in Eden when we committed to materialism. Reflecting on these big-picture issues gives us reason to question this commitment and embrace a radically new account of reality and our relation to it. (shrink)

Our contribution in this paper is to highlight the ethical implications of workforce engagement strategies in an age of austerity. Hard or instrumentalist approaches to workforce engagement create the potential for situations where engaged employees are expected to work ever longer and harder with negative outcomes for their well-being. Our study explores these issues in an investigation of the enactment of an engagement strategy within a UK Health charity, where managers and workers face paradoxical demands to raise service quality and (...) cut costs. We integrate insights from engagement, paradox, and ethic of care literatures, to explore these paradoxical demands—illustrating ways in which engagement experiences become infused with tensions when the workforce faces competing requirements to do ‘more with less’ resources. We argue that those targeted by these paradoxical engagement strategies need to be supported and cared for, embedded in an ethic of care that provides explicit workplace resources for helping workers and managers cope with and work through corresponding tensions. Our study points to the critical importance of support from senior and frontline managers for open communications and dialogue practices. (shrink)

This essay warns of eroding accountability in computerized societies. It argues that assumptions about computing and features of situations in which computers are produced create barriers to accountability. Drawing on philosophical analyses of moral blame and responsibility, four barriers are identified: 1) the problem of many hands, 2) the problem of bugs, 3) blaming the computer, and 4) software ownership without liability. The paper concludes with ideas on how to reverse this trend.

Psychological evidence suggests that laypeople understand the world around them in terms of intuitive ontologies which describe broad categories of objects in the world, such as ‘person’, ‘artefact’ and ‘animal’. However, because intuitive ontologies are the result of natural selection, they only need to be adaptive; this does not guarantee that the knowledge they provide is a genuine reflection of causal mechanisms in the world. As a result, science has parted ways with intuitive ontologies. Nevertheless, since the brain is evolved (...) to understand objects in the world according to these categories, we can expect that they continue to play a role in scientific understanding. Taking the case of human evolution, we explore relationships between intuitive ontological and scientific understanding. We show that intuitive ontologies not only shape intuitions on human evolution, but also guide the direction and topics of interest in its research programmes. Elucidating the relationships between intuitive ontologies and science may help us gain a clearer insight into scientific understanding. (shrink)

It has been claimed that ‘virtuous structures’ can foster moral agency in organisations. We investigate this in the context of employee involvement in corporate philanthropy, an activity whose moral status has been disputed. Employing Alasdair MacIntyre’s account of moral agency, we analyse the results of eight focus groups with employees engaged in corporate philanthropy in an employee-owned retailer, the John Lewis Partnership. Within this organisational context, Employee–Partners’ moral agency was evidenced in narrative accounts of their engagement in philanthropic activities and (...) in their disputes about the moral status of corporate philanthropy. Arma uirumque cano… ‘Je chante les armes et l'homme …’ ainsi commence l’Énéide, ainsi devrait commencer toute poésie.It is far from an overstatement to make the claim that in the surviving corpus of Latin poetry no phrase is more immediately identifiable than the pronouncement of the Virgilian narrator on the ‘arms and the man’ of his subject matter. The presence ofarma uirumquein a particular formation cannot fail to put us in mind of theAeneidand its concomitant ideological associations. A consequence of (...) the epic's centrality as a canonical text was the emergence in antiquity ofarma uirumqueas a synecdochic quotation for the work as a whole and, as such, for the figure of the poet himself. This transformation was further actuated by the ancient practice of ascribing titular authority to a poem's incipit, ensuring that arms and the man took on especial resonance. Even within theAeneid, self-referential intratextual play with the Virgilian utterance can be detected. Furthermore, in post-Augustan verse, Fowler argues thatarmaalone is always loaded in a metaliterary fashion, serving as an identifying marker for Virgil's epic or, more broadly, for epic in general. This was so marked a phenomenon that the opening word of the poem was recycled and reworked by Ovid around a decade after the compositional beginnings of theAeneid, in the first book of theAmores, in what formed an announcement of the redeployment of epicarmainto the elegiac world ofmilitia amoris(Am. 1.1–2). This workshop was designed for faculty teaching at both the undergraduate and graduate levels who incorporate or wish to incorporate climate change and sustainability into their teaching repertoire. Following an introduction, the workshop addressed challenges, frameworks, and models for teaching about climate change and sustainability. Breakout sessions then focused on these three aspects of our teaching. The workshop concluded with a sharing of ideas from the breakout sessions and thoughts on moving forward. This paper argues for the replacement of the Principle of Alternate Possibilities by an alternative principle, the Principle of Possible Non-Performance, which it is argued represents an important improvement on the Principle of Alternate Possibilities in the context of Frankfurt-style examples. The suggestion that the principle offers only the possibility of something insufficiently 'robust' to supply a decent replacement to PAP is countered.

IT WAS an outlandish, ethically questionable experiment, but this was the 1960s after all. Psychiatrist Robert Heath of Tulane University in New Orleans hoped to cure his patients' depression, intractable pain, schizophrenia, suicidal feelings, addiction, and even homosexuality - which in those days was considered a psychiatric disorder - by drowning them out with pleasure, induced by an electrode implanted deep in their brains.

The discourse inside and outside of sport in Australia and abroad on the participation of transgender women in female sport focuses on the principles of fairness, equity and the safety of competitors. These concerns commonly materialise (with little evidence) labelling transgender women as ‘cheats’, dominating female sport, strategically being coached in collision sports to intentionally hurt opponents or fraudulently transitioning with the sole aim of competing in elite women’s sport. Our research examines the process by which the Australian Football League (...) (AFL) grappled with these competing narratives in developing a policy to permit the participation of transgender and gender diverse athletes in community and ‘elite’ competitions. It will be argued that the initial AFL process lacked consideration of the human rights of transgender women and did not provide the necessary resources required to ensure a safe and inclusive process for transgender women to engage with the AFLW competition. This article will also identify lessons which other sport governing organisations should heed in developing and implementing policies for the inclusion of transgender women in sport. (shrink)

This paper explores the experiences of infertile women who occupy a liminal space in society, and argues that the fertility clinic served as a space to tolerate women's experiences of liminality. It provided not only rituals aimed at transition to pregnancy, but also a space where women's liminal experiences, which are caused by the existential chaos of infertility, could be tolerated. The British experience seemed to differ from the American one identified in the literature, where self‐management and peer group support (...) are described as strategies used by infertile women to manage infertility. The British women in this study did not appear to draw so much on self‐management or peer group support to deal with their experiences of infertility. They appeared to be isolated in their experience. The clinic thus provided a space in which recognition was given to their intensely private experiences of difference from those in the outside fertile world and allowed them to manage these socially unacceptable, culturally taboo and invisible experiences. However, because of its very limited success rate in enabling women to become pregnant, rather than facilitating the transition of status from infertile to fertile woman, the clinic also served to reinforce the liminal experiences of those women who remained infertile. Inadvertently, the clinic offered a way of being in limbo while at the same time reinforcing the liminal experiences of women. (shrink)

In historical claims for nativism, mathematics is a paradigmatic example of innate knowledge. Claims by contemporary developmental psychologists of elementary mathematical skills in human infants are a legacy of this. However, the connection between these skills and more formal mathematical concepts and methods remains unclear. This paper assesses the current debates surrounding nativism and mathematical knowledge by teasing them apart into two distinct claims. First, in what way does the experimental evidence from infants, nonhuman animals and neuropsychology support the nativist (...) hypothesis? Second, granting that infants have some elementary mathematical skills, does this mean that such skills play an important role in the development of mathematical knowledge? (shrink)

This 1999 book demonstrates a method for reading the texts of Aristotle by revealing a continuous line of argument running from the Physics to De Caelo. The author analyses a group of arguments that are almost always treated in isolation from one another, and reveals their elegance and coherence. She concludes by asking why these arguments remain interesting even though we now believe they are absolutely wrong and have been replaced by better ones. The book establishes the case that we (...) must rethink our approach to Aristotle's physical science and Aristotelian texts, and as such will provoke debate and stimulate new thinking amongst philosophers, classicists, and historians of science. The purpose of this article is to present a new distributed interactive career decision-making framework in which person and context together determine the development of a sustainable career. We build upon recent theories from two disciplines: decision theory and career theory. Our new conceptual framework incorporates distributed stakeholders into the career decision-making process and suggests that individuals make decisions through a system of distributed agency, in which they interact with their context to make each career decision, at varying levels of (...) participation, from proactive to reactive. We focus on two key career decision-making drivers originating from the person, and two key drivers from the career context. This manuscript challenges the individual-driven approach to career development, and instead proposes that a process of distributed career decision-making takes place between each person and the various stakeholders, both individual and institutional, that also drive their career. Career seekers and counselors can use this framework to supplement an individual-focused approach and incorporate the role of distributed decision-makers in sustaining an individual’s career. Empirical research is needed to explore and test the applicability of the framework to career decisions in practice. (shrink)

Why might alternative taxonomies be needed in contemporary life, and how might the notion of categorisation or anti-categorisation be thought speculatively? This essay considers some of the ways that life and matter have been historically divided and segmented and asks how this might be rendered mobile, offering new divisions and definitions for those who exist outside hegemonic segments or scales.

In 1776, the first living giant anteater to reach Europe arrived in Madrid from Buenos Aires. It survived 6 months in the Real Sitio del Buen Retiro before being transferred to the newly founded Real Gabinete de Historia Natural. In 1853, 77 years later, a second anteater was brought to London by two German showmen and exhibited at a shop in Bloomsbury, where it was visited by the novelist Charles Dickens. The animal was subsequently purchased by the Zoological Society of (...) London, which classed it as one of the most important additions to the menagerie since its formation in 1828. Drawing on recent work in animal biography, this article assesses the reception of the two anteaters and considers their cultural and scientific significance. I examine the logistics of the exotic animal trade and trace the transatlantic networks that permitted anteaters-and knowledge about them-to move between continents. I also study the modes of representation, from painting to taxidermy, that enabled the anteaters to reach new audiences. By focusing in detail on the lives of two exceptional anteaters, the article illuminates understandings of the species more broadly and shows how different spaces and places shaped the creation and dissemination of zoological knowledge. I emphasise, in particular, the tensions that emerged between imperial and colonial science and the competing knowledge regimes of the natural history museum, the menagerie, and the field. (shrink)

abstract Michael Otsuka claims that it is impermissible to kill innocent threats because doing so is morally equivalent to killing bystanders. I show that Otsuka's argument conflates killing as a means with treating a person herself as a means. The killing of a person can be a means only if that person is instrumental in the threat to Victim's life. A permission to kill a person as a means will not permit killing bystanders. I also defend a permission to kill (...) innocent threats against Otsuka's Trolley Cases. Otsuka depicts a person tied to an oncoming trolley as a bystander. I argue that such characters are threats whom Victim can permissibly kill. (shrink)

Contemporary official parenting advice about disciplining children can be boiled down to ‘Be nice’. I first expand on this claim, drawing on primarily Birth to Five and secondarily Parentchannel.tv, showing that ‘Be nice’ breaks down into the absence of punishment and the expansion of both positive reinforcement and leading by example, these three components comprising an approach that is popularly described as positive parenting. Second, I examine the ways in which such apparently innocuous advice could be damaging: positive parenting is (...) arduous if not impossible, thereby setting parents up to fail, and partly because of this onerousness, it is arguably destructive of the spontaneity of the parent–child relationship. However, the difficulties of upholding a whole-heartedly spontaneous approach to parenting have led critics to endorse a model of the good parent as the reflective parent, and in conclusion I warn that this is just as coercive as the positive parenting model that it is designed to replace. I construct a genealogy of the principle of distinction; the injunction to distinguish between combatants and civilians at all times during war. I outline the influence of a series of discourses--gender, innocence, and civilization --on these two categories. I focus on the emergence of the distinction in the seventeenth-century text "On the Law of War and Peace", authored by Hugo Grotius, and trace it through the twentieth-century treaties of the laws of war--the 1949 Geneva Protocols and the 1977 Protocols Additional. I draw out how the practices of and referents for our current wars partially descend from and are governed by the binary logics of Christianity, barbarism, innocence, guilt, and sex difference articulated in Grotius's text. These binaries are implicated in our contemporary distinction of "combatant" and " civilian," troubling any facile notion of what "humanitarian" law is or what "humanitarian" law does, and posing distinct challenges to theorizations of the laws said to regulate war. Because mourning and memorializing a miscarriage seems to imply acceptance of foetal personhood, feminists have been reluctant to address the often traumatic but common experience of pregnancy loss. Feminist anthropologists of reproduction have argued that adopting a view of personhood as constructed and negotiated, rather than inherent, solves this dilemma and enables the development of a feminist discourse of pregnancy loss. This article aims to make a critical contribution to such a discourse by analysing representations of lost babies and children (...) in online pregnancy loss memorials. It focuses on two genres of representation, idealized angels and medical ultrasound images. It argues that the dominance of a biological model of personhood limits the ability of both forms of representation to secure the status of memorialized children as real. However, pregnancy loss memorials do communicate the anguish of grieving parents, in part through the very unrepresentability of their loss. They also provoke a questioning of the taken for granted subject of `the child', whether imagined or real, absent or present. (shrink)

Embryogenesis requires the precise movement and reorganization of many cell and tissue types. Presumably, cell surface receptors allow cells to interact selectively with adjacent cells and with the extracellular environment, as well as initiate differentiative events by transducing appropriate signals across the plasma membrane. One cell surface component that serves as a receptor during a variety of cellular interactions is β1,4‐galactosyltransferase. Cell surface galactosyltransferase participates in diverse cellular interactions by binding its specific glycoconjugate substrate on adjacent cell surfaces or in (...) the extracellular matrix. Biochemical, immunological, and molecular probes are being used to better define cell surface galactosyl‐transferase functional in cellular interactions during fertilization, intercellular adhesion, cell migration, and growth control. In turning to photography the paper explores ways of conveying historical truth. It seems that contemporary art places itself at the very limit of representation in an attempt to remain faithful to historical eventuality. In fact, one is reminded of the type of historical occurrence which can be grasped only through ‘as-if presentations’, to remember the Kantian term. ‘Fiction’, therefore, is no longer opposed to ‘truth’, but becomes its conductor and ally.

This study is unique in that it presents the first empirically developed framework for use as a tool for measuring historical empathy. The Historical Empathy Measurement Tool (HEMT) was developed using a design-based research method with three iterative macrocycles of design, experiment, and retrospective analysis. The study involved question responses from 276 students in grade 8 studying WWI trench warfare. The research resulted in a framework of seven levels. (0) Non-response, (1) Facts, (2) Assumptions and Deficits, (3) General Comparison of (...) the Past and Present, (4) Emotional Comparison of the Past and Present, (5) Understanding Motives, Behaviors, Thoughts, & Emotions in the Past, and (6) Acknowledgement of Differences from those in the Past. Our paper explores how the affective energies and cultural expectations set in motion by best-selling American sentimental novels like Hannah Foster's The Coquette and Susanna Rowson's Charlotte Temple informed the notorious mid-nineteenth-century American trial of Amelia Norman, who attempted to kill the man who seduced her. Once newspapers, defense lawyers, and reformers such as Lydia Maria Child recast the defendant as a sentimental heroine, the trial became about seduction, and Norman was acquitted against the weight of the evidence. Sentimental novels (...) turn on the contrast between the passive victim status of the heroine and the active libidinal quest of the rake-villain. As Cathy Davidson points out, this fiction is "about silence, subservience, stasis (the accepted attributes of women as traditionally defined) in contradistinction to conflicting impulses toward independence, action, and self expression (the ideals of the new American nation)." The seduction plot diverts attention from this disparity by establishing an affective solidarity between heroine and reader and elevating the ruined woman to a tragic status. The sentimental emplotment of Norman's life marshaled a powerful set of emotional responses and moral judgements on her behalf. Norman claimed insanity. And since sentimental heroines are supposed to go mad when they are seduced and abandoned, the jury was prepared to interpret her symptoms according to her lawyers' very strategy for establishing her innocence. Ultimately, however, Norman embodied the plight of the sentimental heroine at the same time that she contested her fictional counterpart's fate. In this way, her trial spectacularized the disparity which the sentimental novel conjures up and displaces but never resolves. The common law theory of coverture, which severely limited the legal personhood of married women, has received a great deal of scholarly attention. Cases like Norman's remind us that unmarried women were also subject to draconian constraints on their legal personhood. The tort of seduction is a key example. Legal historians trace the development of the seduction tort from its common-law origins, when men's property interest in women's bodies formed the basis of the cause of action, to 1851, when Field Code authors (including Norman's lawyer David Graham) persuaded several states to grant seduced women standing to bring their own cause of action. Consequently, courts were forced to reckon with the seduced woman as a moral agent capable of consenting to sex. As trials like Norman's demonstrate, sentimental novels helped lay the groundwork for this shift in the law by elucidating a subjectivity for the seduced woman. Yet the doctrinal implications of Norman's precedent-setting trial had a second, more ambiguous strain. Norman's sentimental strategy proved so powerful that men on trial for killing their wive's seducers appropriated it to bring their own stories before juries and to reinforce male sexual norms. In the end, then, Norman's trial fostered legal reform, but it also suggested - as Child's fictionalization of the case in "Rosenglory" recognized - that only sustained and multifaceted efforts to change cultural as well as legal norms could improve the sexual status of women. Scholars such as Wai Chee Dimock have argued for a focus "on the historical and historically shifting relations between law and literature" - a view we endorse. Where we differ from Dimock is in our diversion of attention away from abstract ideas of law laid out by treatise writers and philosophers in favor of law experienced and manipulated by individuals. So, too, we are interested less in representations of concepts such as justice in legal and literary texts than we are in the ways in which literature (broadly conceived) can create provisional and fragile opportunities for concrete instantiations of justice and even generate legal change (for good or ill). Going further, we would argue that to the extent legal change motivates rather than simply mirrors cultural change, it needs literature to be effective. Thus, we see no need to characterize - and indeed reject the depiction of - law as "a limited arena" in which ideas of morality have little place. This project, then, responds to Gregg Crane's call for attention to "the complex and slippery historical interactions of law and literature that shape and are shaped by an ever changing cultural idiom of justice." The extended story of Amelia Norman not only constitutes a case study in the inescapable interaction between the overlapping and interdependent discourses of law and literature, but also reveals the literary and legal consequences of that interaction.
